Sen. John Kennedy, R-La., pressed former Special Counsel Jack Smith during a contentious exchange at a Senate Judiciary Committee hearing on Tuesday, questioning Smith about his personal politics, his pursuit of the special counsel role, and how he obtained phone records tied to the investigation into President Trump.
Kennedy opened by asking Smith whether he was disappointed when Trump defeated Hillary Clinton in 2016. Smith declined to answer questions about his personal views or his family, saying he was there to discuss his work as special counsel. When Kennedy raised Smith’s spouse’s connection to former First Lady Michelle Obama, including a documentary she made that was sold to Netflix, Smith repeated that he would not discuss his family.
Smith did note that after the 2016 election, he accepted a position as acting U.S. attorney in Tennessee in the Trump administration, followed by a role as a war crimes prosecutor, also under the Trump administration.
Dispute Over Phone Records
Kennedy then turned to how Smith’s team obtained phone records, including those of members of Congress, while seeking non-disclosure orders from Judge James Boasberg. Kennedy alleged Smith did not inform the judge that lawmakers’ phone records were being sought. Smith responded that his team
