Federal Appeals Court Revives Gun Industry Challenge to New Jersey Liability Law

A federal appeals court has cleared the way for a gun industry trade group’s lawsuit against a New Jersey liability law to proceed, after the state began enforcing the measure against companies including Glock.

A federal appeals court has revived a lawsuit challenging a New Jersey law that allows the state to hold gun industry members liable for crimes committed with legally sold firearms.

The U.S. Court of Appeals for the Third Circuit ruled Tuesday that the National Shooting Sports Foundation (NSSF) can continue its case against A1765, the state law the trade group says conflicts with the federal Protection of Lawful Commerce in Arms Act of 2005.

The case, NSSF v. Platkin, was first filed in February 2025 but was thrown out because the group had sued before New Jersey had actually enforced the law against any company, leaving NSSF without legal standing at that point. That changed after former state Attorney General Matthew Platkin filed lawsuits against several firearms industry members, including GLOCK, Inc.
